Supreme Court decided earlier today not to hear our appeal in the Continental Carbon Company versus Action Marine case that our company submitted to the Court in August 2007. HOUSTON (Apr. 10, 2007) – Continental Carbon Company announced today that it is filing a
petition for rehearing of last month’s decision of the United States Court of Appeals, Eleventh
Circuit affirming a $20.7 million judgment in favor of four plaintiffs for surface staining
allegedly caused by emissions from the company’s Phenix City, AL carbon black production
facility. Included in the award is $17.5 million in punitive damages, an amount that is more than
